These Terms and Conditions (“Terms”) govern your use of the websites, apps, and related services operated by Absolute Bollocks Creations (“we”, “us”, “our”), including:

Nothing in these Terms is intended to limit any mandatory rights you have under the law of the country or state where you are resident as a consumer.

In case of any conflict between these Terms and Paddle’s consumer terms regarding payment, tax, refunds, cancellation rights, or dispute resolution for a purchase processed by Paddle, Paddle’s terms prevail for that transaction.
Some of our apps are distributed through third-party platforms (for example, Google Play or Garmin Connect IQ). When you obtain a product through such platforms:

When you purchase a Product from us through Paddle’s invoicing or checkout:
Your purchase contract for that Transaction is between you and Paddle, and is formed when Paddle confirms payment and makes the Product available, in line with Paddle’s consumer terms. Our separate role is to license and support the Product you have obtained.
Many of our Products are digital content (for example, software licenses, digital bundles, or unlock-code–driven access) that may be delivered or activated immediately after purchase.
If you are a Consumer in a jurisdiction that grants a “cooling-off” period for digital content, you may normally have a short window to withdraw from a distance contract. However, under Paddle’s terms and applicable law:

For Transactions processed by Paddle:
We do not process payment card data directly for Paddle-processed purchases and do not have authority to override Paddle’s refund or billing decisions, except where required by law.
Some Products may be offered on a subscription basis (for example, monthly or annual access to a bundle). When Paddle manages these subscriptions:
We may receive non-payment status updates from Paddle (for example, failed renewal) so that we can adjust your license or unlock-code eligibility accordingly.
For some Products (such as Garmin apps or integrations), we may use unlock codes or similar mechanisms to activate features after your purchase has been confirmed by Paddle or another platform. You agree that:
The terms governing how you may use the Product itself (for example, permitted uses, restrictions, and device limits) are set out in our product-specific license terms and in these Terms.
You agree to use the Services only for lawful, personal purposes and to comply with all applicable laws. You must not:
Many of our products interact with fitness equipment, sensors, or training data. They are designed for general fitness and informational purposes only and are not a medical device or medical service.
You are solely responsible for:
To the fullest extent allowed by law, we are not liable for injuries, health outcomes, or equipment damage arising from your use or misuse of our products.
Unless otherwise indicated, all rights in our software, designs, documentation, graphics, trademarks, and other content are owned by Absolute Bollocks Creations or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use our Products and websites for personal purposes, subject to these Terms and any product-specific licence.

Your sole and exclusive remedy for dissatisfaction with the Services is to stop using them (and, where applicable, uninstall the relevant app). For Paddle-processed purchases, your statutory rights and any remedies set out in Paddle’s consumer terms remain available.
Paddle’s consumer terms allow Paddle, in some circumstances, to transfer its rights and obligations under the purchase contract to us as Supplier. If Paddle does so in relation to a Product:
For Transactions processed by Paddle, the applicable governing law and dispute resolution mechanisms are set out in Paddle’s consumer terms. Those terms currently distinguish between U.S. Consumers and Consumers elsewhere, but you should always refer to the most recent version on Paddle’s legal pages.
For issues relating to our Services that are not governed by Paddle’s consumer terms (for example, disputes over product behaviour, documentation, or our independent website content), these Terms are governed by the laws of the United States and the U.S. Virgin Islands, without regard to conflict-of-law rules.
If a dispute arises, we and you will first attempt to resolve it informally through good-faith discussions for at least thirty (30) days. If it cannot be resolved, and where permitted by law, the dispute may be submitted to binding arbitration in the U.S. Virgin Islands.
To the fullest extent allowed by law, you agree that any claims will be brought only on an individual basis and not as part of any class, collective, or representative action. This does not affect any non-waivable rights you may have under the law of your place of residence.
We may update these Terms from time to time, for example to reflect changes in our products, legal requirements, or how we work with Paddle or other platforms. When we make changes:

Your continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services.
